GLYDE Terms & Conditions

These Terms and Conditions apply when you access the GLYDE website or purchase products directly from GLYDE.

GLYDE is operated by Drip Dry Limited, trading as GLYDE Wetsuits.

By using our website or placing an order, you agree to these Terms and Conditions. Please read them before completing your purchase.

Nothing in these terms excludes, restricts or modifies any right or remedy that cannot legally be excluded, including applicable rights under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986 and mandatory consumer laws in the customer’s country.

1. About GLYDE

GLYDE designs and supplies swimming wetsuits, SwimRun wetsuits, swimming equipment, accessories and related products.

Our products are designed primarily for swimming, open-water swimming, triathlon and SwimRun. Individual products may have different intended uses, specifications and care requirements. Please read all relevant product information before purchasing or using an item.

2. Eligibility to purchase

You must be at least 18 years old to place an order or have the permission and supervision of a parent or legal guardian.

When placing an order, you confirm that:

  • The information you provide is accurate and complete
  • You are authorised to use the selected payment method
  • You have read the relevant product information
  • You agree to these Terms and Conditions
  • You are legally permitted to purchase and import the products ordered

We may refuse or cancel an order where we reasonably suspect fraud, unauthorised payment, incorrect information, misuse of a promotion or unlawful activity.

3. Product information

We take reasonable care to ensure product descriptions, specifications, sizing information, photographs and prices are accurate.

However:

  • Colours may appear differently depending on your screen
  • Minor manufacturing variations may occur
  • Product packaging may change
  • Photography may show accessories that are not included
  • Measurements and weights may be approximate
  • Products may be improved or updated without notice

These provisions do not limit your rights where a product does not match its description or fails to meet an applicable consumer guarantee.

4. Wetsuit sizing and fitting

Our size charts and fitting recommendations are guides. Wetsuit fit is affected by height, weight, body shape, torso length, shoulder width, swimming experience and personal preference.

A new swimming wetsuit should fit closely against the body. It may feel tighter on land than it does once it has been positioned correctly and entered the water.

Before deciding that your wetsuit is the wrong size, we strongly recommend that you:

  1. Read the fitting instructions supplied with your wetsuit
  2. Watch the GLYDE fitting video
  3. Position the wetsuit correctly from the legs upward
  4. Check that the crotch, hips, torso and underarms are properly seated
  5. Contact GLYDE if you remain uncertain

Selecting a size based on our size chart or advice cannot guarantee a perfect fit because every swimmer’s body shape and fit preference are different.

Where we have made a clear error in our written sizing advice, please contact us so we can review the situation fairly.

5. Inspecting and trying on a wetsuit

Please inspect your wetsuit carefully before trying it on.

GLYDE may photograph the front and back of each wetsuit before dispatch to record its condition. We also recommend that you take clear photographs before fitting the wetsuit for the first time.

When trying on a wetsuit:

  • Remove watches, jewellery and sharp objects
  • Take extra care with long or sharp fingernails
  • Use suitable gloves where possible
  • Do not pull the wetsuit using your fingernails
  • Do not pinch or pull small areas of neoprene
  • Move the material upward gradually
  • Consider using the inside-out fitting method
  • Follow our fitting instructions and video

The inside lining is generally more resistant to fingernail damage than the smooth outer surface. Gloves can reduce the risk of damage but cannot guarantee that damage will not occur.

Damage caused while trying on a wetsuit may prevent it from being accepted as a change-of-mind return.

6. Orders and acceptance

After placing an order, you should receive an order confirmation. This confirms that we have received your order but does not necessarily mean the order has been accepted.

Your order is accepted when we confirm dispatch or make the product available for collection.

We may contact you if:

  • A product is unavailable
  • There is an error in the price or description
  • Additional delivery charges apply
  • The destination is not currently serviceable
  • Your order appears unusual or potentially fraudulent
  • We need further information to process the order

If we cannot accept an order after payment has been taken, we will refund the amount paid for the affected item.

7. Prices and currencies

Prices may be displayed in New Zealand dollars or another selected currency.

Currency conversions may be approximate. Your bank, card issuer or payment provider may apply its own exchange rate and charge international transaction or currency-conversion fees.

Unless otherwise stated:

  • New Zealand prices include GST
  • International prices may not include local taxes, duties or customs charges
  • Delivery costs are calculated separately
  • Prices may change without notice

A price change will not affect an order that has already been accepted.

If a product has been listed at an obviously incorrect price, we may contact you before accepting the order. You may choose to pay the correct price or cancel the affected item for a full refund.

8. Payment

Payment must be completed using one of the methods offered at checkout.

You authorise GLYDE and our payment providers to process the payment information supplied with your order.

GLYDE does not normally receive or store complete payment-card details. Payments may be processed through Shopify or another approved payment provider and may also be subject to that provider’s terms and privacy practices.

Where instalment or buy-now-pay-later services are available, your agreement with that provider is separate from your agreement with GLYDE.

9. Discounts and promotional codes

Discount codes and promotional offers:

  • Must be used before their expiry date
  • Cannot be exchanged for cash
  • May be limited to selected products, customers or countries
  • May require a minimum purchase
  • Cannot be applied retrospectively
  • Cannot normally be combined unless expressly stated
  • May be limited to one use per customer
  • May exclude shipping costs, duties and taxes
  • May be withdrawn or corrected where issued or advertised in error

We may cancel or decline a discount obtained through unauthorised sharing, manipulation, duplicate accounts, false information or misuse of a collaborator or affiliate programme.

Your rights relating to faulty or misrepresented products are not affected by the use of a discount.

10. Pre-orders and backorders

Estimated arrival and dispatch dates for pre-order or backordered products are estimates only.

Delays may occur because of manufacturing, freight, customs, port congestion, weather, border restrictions or circumstances outside our reasonable control.

We will provide updates where a material delay becomes known.

If a delay becomes unreasonable, you may contact us to discuss cancellation and a refund for the undelivered item.

Where an order contains available and pre-order products, we may hold the order until everything is available or dispatch it in separate shipments.

11. Worldwide shipping

GLYDE offers international shipping to approved destinations.

The availability of international shipping may depend on:

  • Courier coverage
  • Import restrictions
  • Local laws
  • Customs requirements
  • Political or security conditions
  • Carrier limitations
  • The size, weight or type of product

We may temporarily suspend shipping to a country or region where safe or reliable delivery is unavailable.

Delivery prices and estimated timeframes will normally be displayed at checkout. If the actual shipping cost is substantially different because of an address, remote location or carrier restriction, we will contact you before dispatch.

12. Delivery timeframes

All delivery timeframes are estimates unless GLYDE expressly guarantees a specific service in writing.

Delivery may be delayed by:

  • Customs processing
  • Border inspections
  • Weather
  • Flight or freight disruption
  • Peak seasonal demand
  • Local courier delays
  • Remote delivery locations
  • Incorrect or incomplete addresses
  • Events outside our reasonable control

GLYDE is not responsible for delays outside our reasonable control. However, we will provide reasonable assistance and will continue to meet any delivery obligations imposed by applicable consumer law.

13. Delivery addresses

Customers must provide a complete and accurate delivery address.

Please check your address carefully before confirming your order. Contact us immediately if you discover an error.

We cannot guarantee that an address can be changed after an order has entered processing or been dispatched.

Additional expenses caused by an incorrect, incomplete or undeliverable address may be charged to the customer where permitted by law.

We may be unable to deliver to PO boxes, parcel lockers, military addresses or certain remote locations, depending on the courier service.

14. Tracking and delivery confirmation

Tracking information will normally be provided where the selected delivery service includes tracking.

A parcel may be treated as delivered when the carrier’s tracking system records delivery to:

  • The address supplied with the order
  • A person at that address
  • An authorised safe place
  • A collection point selected by the customer or carrier

If tracking shows delivery but you cannot locate the parcel, contact us promptly so we can investigate.

15. Customs duties and import taxes

Unless checkout expressly states that duties and taxes are included, international customers are responsible for all applicable:

  • Customs duties
  • Import taxes
  • Sales taxes
  • Value-added taxes
  • Brokerage fees
  • Clearance charges
  • Local government fees

These charges are imposed by the destination country and are not controlled by GLYDE.

Customers are responsible for checking their country’s likely charges and import requirements before ordering.

Customs authorities may request identification, tax numbers or additional information from the recipient. Failure to provide the required information may delay or prevent delivery.

16. Import restrictions

Customers are responsible for ensuring that products ordered from GLYDE may legally be imported, owned and used in their country.

GLYDE is not responsible where a product is delayed, detained, confiscated or destroyed because it is prohibited or restricted in the destination country, except where we have made an incorrect or misleading representation about its availability.

We reserve the right to cancel an order if we become aware that delivery would breach a law, sanction, trade restriction or courier requirement.

17. Refused and unclaimed international deliveries

If an international delivery is refused, unclaimed or returned because:

  • Duties or taxes were not paid
  • Customs information was not supplied
  • The address was incorrect or incomplete
  • Delivery attempts were unsuccessful
  • The recipient did not collect the parcel
  • The product could not legally be imported

we may deduct the original shipping cost, return freight, customs charges and other reasonable expenses from any refund, where permitted by law.

A refund will normally be considered only after the returned parcel has been received and inspected by GLYDE.

If the cost of returning the parcel exceeds its value, the parcel may be abandoned or destroyed by the carrier. In these circumstances, a refund may not be available unless required by law.

18. Lost or damaged deliveries

If your order is lost or arrives damaged, contact us as soon as reasonably possible.

Please retain:

  • The product
  • Original packaging
  • Shipping labels
  • Photographs of the parcel
  • Photographs of the damaged product

We may need this information to investigate with the carrier.

Where GLYDE arranged delivery, we will meet our obligations under applicable consumer law. Depending on the circumstances, this may include replacement, repair, refund or another appropriate solution.

19. Change-of-mind returns and size exchanges

We offer change-of-mind returns and size exchanges within 30 days of delivery, provided that:

  • The product is unused
  • It has only been tried on carefully
  • It is clean, dry and odour-free
  • It is in perfect, resalable condition
  • All tags remain attached and unbroken
  • It is returned in its original packaging
  • It has no marks, cuts, creases, nail nicks or damage
  • You provide proof of purchase
  • You follow our return instructions

Do not return an item without contacting us first.

Email Dan@glydeswim.com with:

  • Your name
  • Order number
  • Product being returned
  • Reason for the return
  • Whether you are requesting a refund or size exchange

Customers are responsible for change-of-mind return postage and the risk of the return shipment.

Original shipping charges, international duties and taxes are not normally refundable for a change-of-mind return.

We recommend using a tracked and insured delivery service. GLYDE is not responsible for a change-of-mind return that is lost or damaged before reaching us.

We will inspect the item after it arrives. If it does not meet the return conditions, we may decline the return and arrange to send the product back at the customer’s cost.

These conditions do not restrict your legal rights where a product is faulty, incorrectly supplied or misrepresented.

20. International returns and exchanges

International customers must contact GLYDE before returning any product.

The customer is responsible for:

  • International return freight for change-of-mind returns
  • Correctly completing customs documents
  • Clearly marking the parcel as returned goods
  • Obtaining tracking
  • Any return-related charges caused by incorrect customs documentation

Do not declare a return as a new commercial sale.

GLYDE is not responsible for duties or taxes charged because a return was incorrectly declared.

For international size exchanges, the customer will normally be responsible for returning the original item and paying the delivery cost for the replacement item.

Because international exchanges can be expensive, we recommend contacting GLYDE for fitting advice before returning a wetsuit.

21. Excluded change-of-mind items

Unless faulty or required by applicable law, change-of-mind returns may not be available for:

  • Gift cards
  • Personalised or customised products
  • Clearance or final-sale products specifically marked as non-returnable
  • Hygiene-sensitive products after protective packaging or seals have been removed
  • Products used in water
  • Products that have been altered or repaired
  • Products damaged through incorrect fitting, handling, care or storage

Any material return exclusion will be identified before purchase where applicable.

22. Faulty, damaged or incorrect products

If you believe a product is faulty, damaged on arrival, incorrectly supplied or does not match its description, contact us as soon as reasonably possible.

Please provide:

  • Your order number
  • A description of the issue
  • Clear photographs or video
  • Information about when and how the issue occurred

We may ask you to stop using the product while we assess the issue. We may also require the product to be returned for inspection.

Depending on the circumstances and your rights under applicable law, the remedy may include a repair, replacement, refund or another appropriate solution.

GLYDE will cover reasonable return costs where we supplied an incorrect product or where a product is confirmed to have a fault for which we are responsible.

23. New Zealand consumer rights

Products supplied to New Zealand consumers are covered by the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

These laws provide guarantees that may include acceptable quality, fitness for purpose, matching the product description and delivery within the agreed or reasonable timeframe.

Nothing in these Terms and Conditions excludes, restricts or modifies rights that cannot legally be excluded.

A change-of-mind return is different from a legal remedy for a faulty or misrepresented product.

24. Consumer rights outside New Zealand

Customers outside New Zealand may have mandatory rights under the consumer laws of their country, state or region.

These Terms and Conditions are not intended to remove rights that cannot legally be excluded or restricted.

If any part of these terms conflicts with a mandatory consumer law applying to your purchase, the mandatory law will apply to the extent of that conflict.

25. GLYDE wetsuit warranty

GLYDE wetsuits include a one-year warranty covering manufacturing faults in stitching, seams and construction, beginning on the original purchase date.

This warranty does not cover:

  • Fingernail or toenail cuts
  • Punctures, tears or abrasions
  • Damage caused while putting the wetsuit on or taking it off
  • Damage caused by jewellery, watches or sharp objects
  • Damage caused by pulling excessively on one area
  • Contact with rocks, sand, pool edges or rough surfaces
  • Incorrect cleaning, drying or storage
  • Heat or prolonged direct sunlight
  • Chlorine or chemical damage
  • Use of unapproved lubricants or substances
  • Modifications or unauthorised repairs
  • Accidents, misuse or neglect
  • Normal wear and tear
  • Cosmetic changes that do not affect performance

This express warranty is additional to, and does not replace, any rights available under applicable consumer law.

26. Accidental wetsuit damage and repairs

Neoprene is flexible but can be damaged by fingernails, sharp objects and rough handling.

A small cut, tear or nail nick is generally accidental damage rather than a manufacturing fault.

Many small wetsuit cuts can be repaired. GLYDE may:

  • Provide information or a video explaining how to complete a suitable repair
  • Recommend an independent wetsuit repairer
  • Assess whether a repair may be possible
  • Offer a paid repair where that service is available

Any repair service, cost and timeframe must be agreed before work begins.

27. Product care

Customers are responsible for following the care instructions supplied with the product.

Wetsuits should generally be:

  • Rinsed in clean, cool fresh water after use
  • Dried naturally away from direct sunlight
  • Kept away from heaters and high temperatures
  • Stored carefully to avoid permanent folds or compression
  • Protected from sharp objects and rough surfaces
  • Used only with approved wetsuit lubricants

Damage caused by failing to follow care instructions may not be covered by our express warranty.

28. Safety and appropriate use

Open-water swimming involves risks, including changing weather, currents, waves, cold water, marine life, boats and reduced visibility.

A wetsuit may provide warmth and some buoyancy, but it is not a lifejacket or approved personal flotation device.

Customers are responsible for:

  • Assessing their swimming ability
  • Checking local conditions and weather
  • Selecting an appropriate location and distance
  • Using suitable safety equipment
  • Following local laws, rules and warnings
  • Swimming with appropriate supervision or support
  • Seeking professional advice where required

Stop using a product if it appears damaged or unsafe.

Information on our website is general information and should not be treated as medical, safety or professional coaching advice.

29. Gift cards

Gift cards may be used for eligible purchases through the sales channel for which they were issued.

Unless required by law or expressly stated:

  • Gift cards cannot be exchanged for cash
  • Gift cards cannot be used to purchase another gift card
  • Lost, stolen or unauthorised gift cards may not be replaced
  • Promotional discounts may not apply to gift-card purchases
  • Refunds for products purchased with a gift card may be returned to a gift card

Any expiry date or country restriction will be disclosed when the gift card is issued.

30. Website accounts

If you create an account, you are responsible for maintaining the confidentiality of your login information and for activity conducted through your account.

Contact us promptly if you believe your account has been accessed without permission.

We may suspend or close an account where it is used fraudulently, unlawfully or in breach of these terms.

31. Customer reviews and submitted content

If you submit a product review, photograph, video or other content, you confirm that:

  • It reflects your genuine experience
  • You have the right to submit it
  • It does not infringe another person’s rights
  • It is not unlawful, abusive, misleading or defamatory

You grant GLYDE permission to display and reproduce the submitted content for website, customer-service and promotional purposes unless otherwise agreed.

We may moderate or remove submitted content where reasonably necessary, but we will not alter a review in a way that misrepresents the customer’s opinion.

32. Intellectual property

The GLYDE name, logos, product designs, product names, photographs, videos, graphics, written content and other website materials are owned by or licensed to Drip Dry Limited.

You may view and use the website for personal shopping purposes.

You may not copy, reproduce, modify, distribute, sell or commercially use our content without written permission.

33. Third-party services and links

Our website may contain links to third-party websites or use third-party services, including payment, delivery, review, social-media and marketing providers.

GLYDE is not responsible for the content, availability or independent practices of third-party websites.

Use of third-party services may be subject to separate terms and privacy policies.

34. Privacy

We collect, store, use and disclose personal information in accordance with our Privacy Policy and applicable privacy law.

Our Privacy Policy explains:

  • What information we collect
  • Why we collect it
  • How it is used
  • Who it may be shared with
  • Whether it may be processed outside New Zealand
  • How it is protected
  • How customers can request access or correction

By using our website, you acknowledge that you have had the opportunity to read our Privacy Policy.

35. Website availability

We aim to keep our website secure, accurate and available. However, we cannot guarantee uninterrupted or error-free access.

We may temporarily suspend or change the website for maintenance, security, technical, operational or commercial reasons.

If an error affects an order, we will work with the customer to provide an appropriate solution.

36. Limitation of liability

To the fullest extent permitted by law, Drip Dry Limited is not liable for indirect or consequential loss resulting from use of the website, delivery delays outside our reasonable control or misuse of a product.

Nothing in these terms excludes, restricts or modifies:

  • Rights under the New Zealand Consumer Guarantees Act
  • Obligations under the New Zealand Fair Trading Act
  • Applicable mandatory overseas consumer rights
  • Liability that cannot legally be excluded
  • Any other mandatory right or remedy

Customers are responsible for using products only for their intended purpose and in accordance with supplied instructions.

37. Events outside our control

GLYDE will not be responsible for delays or failures caused by circumstances outside our reasonable control, including:

  • Natural disasters
  • Extreme weather
  • Transport disruption
  • Industrial action
  • War or civil unrest
  • Border restrictions
  • Customs delays
  • Supplier disruption
  • Power or communications failure
  • Cyber incidents
  • Epidemics or public-health restrictions
  • Government action

We will take reasonable steps to reduce the effects of the disruption and communicate material delays.

This section does not remove rights or obligations that cannot legally be excluded.

38. Wholesale and commercial purchases

Wholesale accounts, distributors, commercial customers, Swimfluencers, suppliers and collaboration partners may be subject to separate written agreements.

These consumer Terms and Conditions do not replace any separately agreed wholesale, distribution, collaboration or commercial terms.

If there is a conflict between these website terms and a separately signed agreement, the signed agreement will apply to the extent of that conflict.

39. Changes to these terms

We may update these Terms and Conditions when our products, services, processes or legal obligations change.

The updated version will be published on our website with a revised “last updated” date.

The terms applying to an accepted order will generally be those in effect when the order was placed.

40. Governing law

These Terms and Conditions are governed by the laws of New Zealand.

Any dispute will be subject to the jurisdiction of the New Zealand courts, except where mandatory consumer law gives an international customer the right to bring a claim in another jurisdiction.

If you have a question or complaint, please contact us first so we have an opportunity to resolve it.
